Eligibility
CHAPTER 7: you are eligible for relief if:
1.-- you have not completed any kind of bankruptcy within the last eight years,
2.-- you do not have some very valuable asset like a non-IRA/401k stock portfolio, or more than $125,000 in home equity (401ks/IRAs cannot be seized in bankruptcy).
3.-- you can show that your regular net income is not much more than enough to meet your ordinary monthly expenses, and your total household yearly gross income was less than the median income for a household of its size calculated using only the most recent full six months. However, even if you are over the median income, you may still qualify for Ch7 if you have certain standard Means Test Rebuttal offsets like high mortgage payments, high car payments, child support payments or out of pocket health insurance.

Chapter 13 eligibility is much broader than Chapter 7 and still an excellent option if you are ineligilble for relief under Chapter 7. Chapter 13 is the preferred method for saving a house from foreclosure. In nearly all cases a Chapter 13 reorganization bankruptcy still automatically stops foreclosure and gives you an extra 36 to 60 months to catch up on your overdue payments while also drastically reducing most of your other debts.
